This contract between the customer and Yay Punta Cana (Hereinafter referred to as the service provider) is subject to the following terms and conditions.

By accessing the website Yay Punta Cana.com you are subject to the following terms and conditions. As a condition of your use of the website, you agree to be bound by the Terms and Conditions. Therefore, please read the Terms and Conditions carefully. We ask that you not use this website if you disagree with these Terms and Conditions. LIABILITY FOR LOSSES/INDEMNITY

In using this website, you agree that YAYPUNTACANA.com will not be held responsible for any direct, indirect, special, consequential or any other loss or damage caused by the use or inability to use the website or your access to additional material on the internet via web links from this website.

You agree to indemnify, keep indemnified, defend and hold harmless YAYPUNTACANA.com, its corporate parents, subsidiaries, affiliates, directors, employees, officers and agents information providers and licensors from and against any and all claims, damages, liability, losses, costs and expenses (including legal fees) (whether or not foreseeable or avoidable) incurred or suffered by any Indemnified Party and any claims or legal proceedings which are brought or threatened arising from your use of, connection with or conduct on the website or any breach by you of these Terms and Conditions. At its own expense, YAYPUNTACANA.com reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate without protest.

SEVERABILITY CLAUSE

In the event that any portion is found to be invalid or unenforceable, the remaining portion of this agreement remains in full force and effect; where appropriate, the portion considered invalid will be construed in accordance with the other portions of this agreement.

APPLICABLE LAW AND LEGAL JURISDICTION

The terms and conditions of the use of this website shall be governed in compliance with the laws of the Dominican Republic. This product contract is construed according to the laws of the Dominican Republic and the customer will be subject to the jurisdiction of the Dominican Republic courts. Customers acknowledge they have read and understand the above terms and conditions and agree to abide by them. Booking online, the customer waives certain legal rights, including the right to sue for damages.

LIABILITY AND ACCEPTANCE OF RISK

This site offers booking services for excursions offered by independent third-party suppliers. YAYPUNTACANA.com is not liable for the actions or omissions of independent contractors providing the excursions for which booking services are provided, and any claims against YAYPUNTACANA.com in connection with the excursions purchased are deemed to have been waived and relinquished.

The products, services, and excursions listed on this website for which booking services may be requested comprise activities that involve risks. Consumers of these services assume all risks associated with such activities. By accepting these services, you as the customer/ purchaser agrees that YAYPUNTACANA.com is not responsible for any losses or damages including bodily injury (including death), property damage, or economic loss incurred as a result of participating in the activity for which booking services are provided. You hereby assume all responsibility for any risk and releases Yay Punta Cana from all claims and causes of action arising from any accident, damages or injuries or death resulting from risks inherent by these excursions,services and activities. You are responsible for any costs (including repair, cleaning fees, and replacement ) incurred by using our equipment or motor vehicle.

We reserve the right to modify excursions without notice. We at YayPuntaCana provide access to high-quality excursions offered by the most trustworthy vendors in Punta Cana. There are excursions that require some physical activity. It is necessary to take into consideration the nature of the excursion in order to determine if it is suitable for your age and physical condition.

TERMS OF ONLINE BOOKING CONTRACT

By booking any transportation in Punta Cana or participating in a local tour, excursions or any other related products or services with Yay Punta Cana, you agree to our website Terms & Conditions.

By booking an excursion package or any related product/s or service/s you acknowledge that you have read, understood and agree to be bound by the Terms and Conditions. In the event that you make a reservation on behalf of another person, you represent and warrant that you have the right and authority to accept these Terms on their behalf.

YAYPUNTACANA.com service providers reserve the right to amend or cancel excursions due to circumstances beyond their control. In such an event, a full or partial refund may be offered; however, the consumer releases YAYPUNTACANA.com or the service provider from any liability arising out of any consequential damages or losses suffered as a result thereof.

CANCELLATION, CHANGES AND/OR REFUND

If you cancel your booking, we will impose cancellation charges as follows:

Within 24 hours of the excursion start time- 100% of the Total Excursion Cost.
25-72 hours prior to the excursion start time- 25% of the Total Excursion Cost.
More than 72 hours before the planned excursion -10% of the Total Excursion Cost.

Any changes to the date and/or time must comply with the following requirements:

(1) Change requests must be made more than 24 hours in advance.

(2) Any alterations on your original booking will incur a $25 charge fee.

If we are unable to conduct your excursion on the original date, and it cannot be rescheduled during your stay, you will receive a 100% refund.

Excursions fee are non-refundable for no-shows.

REQUIRED MEDICAL INFORMATION

Yay Punta Cana reserve the right to ask our clients for medical information disclosure. You may be required to fill out the Tour Operator’s medical questionnaire or to give any medical information that the Tour Operator reasonably requests.

AGE REQUIREMENT

It is not allowed for anyone under the age of 18 to drive any motorized excursions. Our excursions allow one adult to accompany any number of minors.

We have a minimum age requirement for each excursion as we see appropriate. It is the parent/guardian discretion and responsibility upon booking in allowing their kid/s to participate in any of our tour.

Minors, 18 years below are not permitted to drink alcoholic beverages.

Yay Punta Cana reserve the right to confirm any reservation made by a minor. A reservation made by a minor is subject to review and approval by our company. In accordance with applicable local and international law, any minor taking part in an excursion requires the consent of a parent or guardian.
